My information in the profile is the most up to date info I have. My priority date is not current, and I am sorry if something in my previous post gave you that impression.
I am still using my H1B status and my wife is using her EAD, but since we applied for 485 in 2007, we have applied for EAD twice (once with 485 appl and a renewal later) but never received FPs.

Do you think I should still setup an Infopass?

We do have the licence and bank accounts based on the h4 status.

My main question was when we can apply for SSN if the employee is right now in US on H4 visa and Change of Status to H1 is approved. Whether the SSN can be applied before Oct 1 is the main thing !

Congratulations on your permanent resident status (aka green card holder).

1. Your spouse and child are NOT in H4 status anymore effective your I-485 approval date.
2. Since they have filed for I-485, they are in valid AOS Pending status.
3. They must use AP to re-enter USA

Your current employer experience has to be prior to your labor filing date (PD). You can not use the experience you got after the filing date.

You can use your experience with current employer if the future job is substantially different than your current job.

Invite the Senators to this meeting.

I have recently spent 2 weeks in Chennai and my overall taxi experience has been very good being non Tamil speaking. All Taxis charge more when the starting point is Airport. That is inevitable. If it is just to drop them at the nearest hotel, ask them to approach the Govt Prepaid Taxi booth.

Govt's is cheaper compared to the private Taxis. Ofcourse the Govt only has Ambassadors as the Taxis. Do not expect the Taxis to be neat and clean like here. Expect broken handles.....There are 3 other private Taxi booths, of the private taxis Fasttrack seemed a little lesser compared to others, almost all private taxi rates are closer.

If they need the Taxi from hotel check out Fasttrack website and get teh phone no for Chennai. They have been pretty good an picking me on time, but make sure you reserve it well in advance (4-5 hrs). Whenever I called in the last minute, they were not on time.

I did stay at a hotel far from Airport - clsoer to work. So might not be useful to u.

My experience with Taxis at Chennai airport have always been bad. They quote you a rate at the taxi counter and when you go to board the car, they will add on other charges saying that there is a lot of luggage. Anything more than two large suitcases, they charge at least 150 to 200. You have to haggle with them to not pay. Even the people at the counters side with the Taxi drivers.

Of late, I am having a call taxi service come to the airport to pick me up. You can talk to the hotel people to arrange for the taxi. it comes close to the actual fare quoted initially, but you wont have to pay those exhorbitant charges for luggage.

I have one question that I will post here. I do not want to open a new thread.

I am inviting my in-laws and I filled their DS156 forms online. After filling everything, it generated the pdf file of DS156. In that pdf file, there is one section in upper right hand corner called "DO NOT WRITE IN THIS SPACE". Under that section there is a line (fill in the blanks type) starting with "On ______ by _____ under section 214(b) 221(g) ".

Now after generating the pdf, the appointment date was automatically put into this section. Example: "On 01 January 2009 by ......".

I am worried why they put the date there and the date was not there when I took appointment for my parents. I also checked my collegues parents DS156, and the date was still not there. It is Mumbai consulate.

Can somebody please confirm if they had similar experience and they got their parent's or in-laws visa granted??

I am going to allow this thread as we have allowed H4 related and visitor visa related threads for people before, and all visitors visa thread are non-immigrant visa related thread even if they are for parents of EB immigrants.

then my company filed another perm but for a different position and
description..that got approved..

i extened H1 with MTR but lost my priority date..which does not matter to me
since i am EB2 and Rest of the world...just incase my MTR gets accepted

I am trying to file Paper based Advance Parole ( I-131) for me and my family.

I have few questions regarding process and forms. Appriciate your hlep with those.

(1) I Last enetered as F-1. My F-1 visa stamp has expired. I currently have H-1B approved but never stamped on my passport. My I-140 approved and I-485 pending.

On form I-131 in section 3. "Class of admission" what I should write " F-1 "or "H-1B"?

(2) If I check on "More than One trip" in Part-7 section -1 of the form, does the process differ in any way? Does it need any extra fee? Does it need any extra document to support the multiple entry AP application? Will it affect approval in any way? How long (one yr two year?) is AP, once it is approved, is valid?

(3) I never had applied for EAD based on pending I-485 and does not intend to do so in near future.

Does I need to apply for EAD to get AP? and in Cover letter for my AP do I need to mention EAD or it is not required?

(4) For my sons ( 15 yrs age) can I sign as a person preparing form?

Hi, I have a rather unique case. Any help will be greatly appreciated. Below are my details:


While on OPT, I accepted an offer from a company in January. They agreed to sponsor me.

My H1B was processed with premium processing fee.

H1B approved on 04/20/2008. (But it will be effective n October 1st)

I was laid-off on 04/23/2008 (But will receive payment till 04/25/2008)

Am i out of status?
(Technically I was working on OPT; did that change once my application was approved?)

Am i still eligible for employment? (I have my OPT till 06/22)

Can another company apply for another H1B petition for me OPT expires?
(will expire on 06/22/2008) How long do I have to find another employer?

Sorry for your situation. Its tough for you. Guess you need to move out of country since the basis of extension (labor) is also in jeopardy. As someone said, consult a good lawyer quickly.

I just wanted to share my RFE regarding the "Experience Lettters"

I got an RFE "Evidence of experience must be in the form of letter(s) from current or former employer(s) giving the name, address, and title of the employer and a description of the experience of the alien, including specific dates of the employment and specific duties."

The desi company that I worked for in US doesn't exist anymore. I got a affidavit from one of my ex-colleagues who is currently working for a company in INDIA.

And it worked for me. My attorney sent the documents to USCIS on 3/3 and we got an Approval Notice on 3/7.

I have also similar situation where I send my 2 ex-coleague letter(2002), one is notarized and another without notarized for one of the company and other company I have got exp letter with latest date. So I keep my fingure crossed for what ever outcome from USCIS.

probably they may get today or tommarrow and will see the result.

By the way which centre you query was? I have got RFE from Nebraska and case transffered to Texas .

For those of you who are looking to port or have already done so, did you face a similar situation - where your attorney could not advise and assist you through the process of porting? How did you resolve this situation? Did you have to find another attorney to help you with porting to a new job?

What kind of help are you looking for?? Its all in the IV forums about AC21... You need nothing... If you think your employer may revoke your approved I-140.. then you need to inform USCIS of your using AC21 to do a job change... If your I-140 is not approved yet.. you need to wait...
